Terms and Conditions
Please ensure to carefully read the following terms and conditions before agreeing to them. This is a legally binding agreement and will be filed as a record.
By agreeing to the following terms and conditions ("Terms and Conditions"), you agree and acknowledge that:

You will pay any consultation fees ("Consultation Fees") owed to WeTalent Pty Ltd ("WeTalent") for each Consultation you schedule in accordance with WeTalent's Payment Policy or as indicated on the WeTalent website, regardless of the amount to be paid and/or whether additional changes are subsequently applied to such Consultation Fees.

All Consultation Fees must be paid in full to WeTalent through its secure website before consultations ("Consultations" or "Appointments") are scheduled or conducted. Or instalment via Afterpay when this option is available.

WeTalent reserves the right to prevent you from attending a Consultation if payment has not been made and/or successfully approved/confirmed by the due date.

All Consultation Fees are calculated based on WeTalent's Fee Structure and may, from time to time, be altered.

WeTalent reserves the right to make changes to Consultation Fees without prior notice; in such cases, future bookings may be subject to different prices.

In the event of any of the aforementioned changes/alterations, WeTalent will update its website and, whenever you schedule a consultation, the Consultation Fees covering such Consultation will be calculated and charged according to the information available on the WeTalent website at the time of booking (i.e., updated information).

Consultation Fees are predetermined and non-negotiable financial outlays.

Any amounts displayed on the WeTalent website do not include GST (Goods and Services Tax).

Some amounts displayed on the WeTalent website may include other surcharges that may be applicable to the transaction, depending on your chosen payment method or bank.

The WeTalent website may provide you with one (or more) payment options/methods, and by selecting a particular payment option/method, you agree to be bound by any terms and conditions set forth by the provider of such option/method.

Appointments are subject to WeTalent's date and time availability and, therefore, are subject to change.

WeTalent reserves the right to cancel and reschedule your appointment at any time from your booking.

Should you, for any reason, need to cancel and/or reschedule your appointment, you will need to notify WeTalent of the change at least forty-eight (48) hours in advance.

Failure to comply with item 13 may result in WeTalent not granting refunds if requested.

Should you, for any reason, need to cancel your appointment, you will only be entitled to a refund upon submitting a formal request to WeTalent (via email), provided that it complies with WeTalent's Refund Policy (as described in items 16 to 24 of these Terms and Conditions).

If, for any reason, WeTalent needs to cancel or reschedule your appointment, you will only be entitled to a refund upon submitting a formal request to WeTalent (via email).

Any refund requests and/or claims made will be individually assessed by WeTalent.

WeTalent reserves the right not to issue refunds if you fail to comply with any of the provisions set forth in these Terms and Conditions.

WeTalent will make all reasonable efforts to provide you with a full refund of the Consultation Fees paid, should your Consultation be canceled and a request for such refund be submitted to WeTalent, in accordance with items 13 to 16.

All refunds will be processed within three (3) business days after WeTalent's approval of your refund request/claim.

Any other costs or surcharges paid by you to third parties and/or payment providers (such as bank/financial institution or PayPal) are non-refundable.

No refunds will be made available after your Consultation, whether you attended or not.

In light of item 22, if you fail to attend your appointment for any reason and do not cancel or reschedule it as per item 13, no refund will be made available.

In accordance with item 23, non-attendance will not be subject to discounts, refunds, credit, or transfer of dates or times under any circumstances. The same applies in the event you are late for your Consultation.

Upon completing the online booking, your Consultation will be temporarily scheduled for a period of twenty-four (24) hours - after this period, it will be automatically cancelled if the corresponding payment is not made or if WeTalent fails to confirm your payment within this 24-hour grace period. Consequently, if WeTalent fails to verify your payment in time, your appointment will be automatically cancelled and will need to be rescheduled, subject to new availability.

Upon successful receipt and confirmation of your payment, WeTalent will issue a confirmation of your booking. Until then, WeTalent will not be held liable if any other person books a consultation on the date and/or time you selected.

WeTalent shall be exempt from any liability arising from any financial losses as a result of payment issues, changes in consultation times and/or dates, or any other reasons (without limitation), and no other claim for compensation or reimbursement of expenses shall be admissible and/or enforceable against WeTalent.

You shall accept any changes to WeTalent's Fee Structure and pay any differences to cover discrepancies, whenever applicable and/or as indicated by WeTalent. Please note that future changes to WeTalent's fee structure will not affect you once your consultation is paid unless such changes relate to subsequent consultations that will be charged and/or treated as new bookings.

In the interest of all parties, WeTalent reserves the right to terminate any Consultation and to enforce the removal of any person (or persons) from its sessions whose behaviour or demeanour is, in WeTalent's opinion, deemed unacceptable.

Should WeTalent exercise any of the actions described in item 29, you shall not be entitled to any discounts, refunds, and/or reimbursements of amounts paid to WeTalent in relation to the Consultations, as well as any form of credit and/or transfer of the consultation date and/or time.

You are responsible for your own actions and behaviour, as well as the actions and behaviours of any person (or persons) you bring along to your Consultation.

WeTalent reserves the right to postpone and/or cancel any Consultation as a result of disruptive and/or inappropriate behaviour on your part or on the part of anyone attending your Consultation with you.

Any form of abuse on your part (or on the part of anyone accompanying you during the Consultation) directed at any WeTalent personnel (including, but not limited to, its staff and/or other clients) will not be tolerated and will be subject to appropriate action.

Both parties are obligated to adhere to appropriate codes of conduct and to maintain a friendly, respectful, and professional environment.

Throughout your Consultation, a career consultant will ask a series of questions related, but not limited, to your family, educational and professional background, visa history in Australia, and goals within and outside Australia. You agree to provide accurate and up-to-date information to WeTalent representatives at all times.

Any career plans, strategies, and/or advice given to you by WeTalent's Career Consultants are based solely on the information you have provided (or will provide) to them before, during, or after your Consultation. As a result, you are responsible for ensuring the accuracy of such information.

If you fail to provide WeTalent and/or its representatives with any requested information or if you provide incorrect or inaccurate information, the career plans, strategies, and/or advice given to you by WeTalent and its representatives may be compromised. As a result, you will not be entitled to any form of compensation from WeTalent for any losses and/or damages suffered as a result of any misinterpretation, deceptive or deceitful conduct on your part, or as a result of your failure to comply with items 35 and 36.

WeTalent does not offer any guarantees regarding the fulfilment of eligibility requirements or the approval of positions and/or any other selection processes explained and/or recommended to you during your Consultation. Similarly, no guarantees are made in any of these aspects.

By allowing a third party to be present in a Consultation, honouring the items in these Terms and Conditions that reference such person(s), you agree to be solely responsible for them and their actions/behaviour.

WeTalent shall not be held liable for any loss or damage suffered if any third party attending your Consultation with you discloses and/or makes use of the information/advice/recommendations provided to you by a Career Consultant during such Consultation.

As part of WeTalent's fiduciary duties to act in your best interest and in accordance with the law, WeTalent will keep all your personal information confidential and will not disclose it to unauthorised third parties.

For the purposes of items 35 through 41, Consultations may refer to any services provided by WeTalent, including but not limited to services related to career counselling and/or professional skills assessment.

WeTalent may, on certain occasions, grant clients the right to free Consultations. WeTalent, however, reserves the right to change its Booking Policies and remove ownership rights from any future bookings without prior notice. Please note, however, that any rights you obtain at the time of your booking will be honoured by WeTalent, while any rights not tied to your booking (whether because they have been removed from WeTalent's Booking Policies or are no longer applicable to your booking's circumstances) will not be honoured.

You acknowledge that the above Terms and Conditions are fair, equitable, and enforceable.

If, for any legal reason, any of the provisions/items set forth in these Terms and Conditions is deemed invalid and/or void by a court, or is in conflict with another provision/item, the remaining provisions/items shall still be applicable to both parties, according to this agreement itself.

These Terms and Conditions are in accordance with and governed by Australian law, and all parties shall submit to the jurisdiction of the Australian Courts.

Once agreed upon, these Terms and Conditions become a legally binding document that may be executed in duplicate to ensure compliance with its provisions. As such, any violations of the above items should be treated as a breach of the contractual agreement.

You have read and fully understand the above Terms and Conditions and agree irrevocably to comply with them for an indefinite period of time.

We do not offer any immigration advice and strategies. To learn about your eligibility in terms of immigration, we suggest you consult with an immigration agent registered by the Australian government.

Failure to submit the necessary professional information to compose the client's material, such as Resume, Cover Letter, and LinkedIn, renders the delivery of the final version revised by our consultants unfeasible. Respecting the pre-established deadlines of each service, the client will have a maximum of 45 business days from the beginning to the end of the consultancy process to go through all its stages. After this period, the process will be considered closed as part of the client's responsibilities regarding compliance with deadlines.

I understand that WeTalent's services do not substitute for counselling, psychotherapy, psychoanalysis, mental health care, or therapy.

I release, waive, absolve, and discharge WeTalent, any agents, directors, consultants, successors, assignees, personal representatives, executors, heirs, and employees from all claims, lawsuits, demands, or rights to compensation for damages that I may claim to have or that may arise from acts or omissions on my part or on the part of my Consultant as a result of advice given by my Consultant or otherwise resulting from the career relationship contemplated by this contract.

Remarkable results can be achieved when clients follow a clear plan consistently. However, the client is solely responsible for making important decisions in their professional life. WeTalent is not responsible for any loss suffered by any client, whether financial or otherwise, after the start of career sessions, or for any perceived failure by the client, whether justified or not, to achieve an improvement in their professional life or to achieve the desired results or goals.

The number and frequency of career sessions will be agreed upon at the outset between WeTalent and the client through scheduling made on our website where the client will receive a confirmation email.

The date on which the first career session occurs will be considered the start date of the service. Whenever a client is dissatisfied with any of the terms and conditions, they may contact WeTalent to discuss any concerns and see if they can be resolved before the first session.

The date and time of the first session and of any subsequent session will be agreed upon between WeTalent and the client according to the calendar available on our website.

WeTalent may assign the client tasks or exercises to be completed between career sessions. There is no obligation for the client to complete these 'homework' items, but failing to do so may delay the client's performance in achieving desired professional results.

The client will receive support via WhatsApp for up to 66 days after the end of the consultancy for the services: Academy, Kickstart, Accelerator, and Accelerator + Migration. After this period, any service or support is understood as new, and fees will apply.
